EABC Clarifies No Stance To Oppose Health Warning, Calls For Balanced Regulations

Bangkok, 31 May 2016 – Following the media reporting on the courtesy call made by the European Association for Business and Commerce (EABC) to the Minister of Industry Mrs. Atchaka Sibunruang, there was a misreporting on the view of the EABC on the health warning on cigarette packs.

EABC Vice President Mr. Jan Eriksson clarifies that the EABC does not oppose reasonable health warnings on products such as tobacco and alcohol. However, the EABC is of a view that extreme measures, such as plain packaging in tobacco products and a very broad and unclear labelling regulation for alcoholic beverage, encroach on intellectual property and may have negative impacts on Thailand’s obligation under the WTO’s Intellectual Property agreement as well as the Technical Barrier to Trade Agreement.

The EABC believes that such measures are extreme because the proposal prohibits businesses to use their registered trademarks and other valuable intellectual property in brandings which are protected by both domestic and international laws.

The EABC therefore encourages cooperation from the Thai Industrial Standard Institute (TISI), as an agency responsible to inform the WTO country members and seek the necessary views in advance and to also play a role in advising relevant authorities in order to prevent any regulatory conflicts that may impair Thailand’s ability to comply with the WTO regulations.

จากกรณีที่มีการรายงานข่าวภายหลังที่สมาคมการค้ายูโรเปียนเพื่อธุรกิจและการพาณิชย์ (EABC) เข้าเยี่ยมคารวะรัฐมนตรีว่าการกระทรวงอุตสาหกรรมนางอรรชกา สีบุญเรือง ได้ปรากฏว่ามีการรายงานข่าวที่คลาดเคลื่อนในส่วนของความเห็นของสมาคมฯ ในประเด็นภาพคำเตือนบนซองบุหรี่

ทั้งนี้ นายแจน อิริคสัน รองประธานสมาคม EABC ได้ชี้แจงว่า สมาคมฯ ไม่ได้มีความเห็นในการต่อต้านการปิดฉลากเตือนพิษภัยและโทษของการสูบบุหรี่ แต่ได้หยิบยกถึงมาตรการต่างๆ ที่อาจส่งกระทบต่อข้อตกลงทรัพย์สินทางปัญญา และความตกลงว่าด้วยอุปสรรคทางเทคนิคต่อการค้า (Technical Barrier to Trade Agreement) เนื่องจากปัจจุบัน ได้มีการยกร่างกฎหมายด้านสุขภาพขึ้นมาหลายมาตรการ เช่น การปิดฉลากเครื่องดื่มแอลกอฮอล์ และข้อเสนอซองบุหรี่แบบเรียบ (Plain Packaging) ซึ่งทางสมาคมฯ มองว่าเป็นมาตรการที่สุดโต่งเกินไปเพราะเป็นการห้ามไม่ให้ผู้ประกอบการใช้เครื่องหมายการค้าของตน ตลอดจนทรัพย์สินทางปัญญาในเรื่องแบรนด์บนผลิตภัณฑ์ของตนทั้งๆ ที่เป็นสิ่งที่ได้รับการคุ้มครองตามกฎหมายทั้งในประเทศและในระดับสากล โดยทางสภาฯ ได้ร้องขอให้สำนักงานมาตรฐานผลิตภัณฑ์อุตสาหกรรม (สมอ.) ซึ่งเป็นหน่วยงานที่ทำหน้าที่แจ้งให้สมาชิกของ WTO ทราบเป็นการล่วงหน้าหากมีการออกกฎระเบียบใดๆ ที่มีผลบังคับใช้เป็นกฎหมายเกี่ยวกับคุณภาพ มาตรฐานของสินค้าอุตสาหกรรมทุกชนิด ให้คำแนะนำกับหน่วยงานต่างๆ เพื่อช่วยป้องกันมิให้การออกกฎระเบียบใดๆ ในประเทศ อาจขัดต่อข้อบังคับในข้อตกลงต่างๆ ที่ไทยมีผลผูกพันในฐานะประเทศสมาชิก WTO
