DESCRIPTION:Japan’s Ministry of Economy\, Trade and Development (METI)\, the European Commission\, and the Organisation for Economic Cooperation and Development (OECD) are jointly hosting this seminar on the implementation of international expectations on responsible business conduct (RBC) / CSR by European and Japanese businesses. \nWith Japanese and European companies expanding their supply chains across Thailand and the Asia region\, the session will showcase best practices and challenges businesses are facing in addressing supply chain risks\, and explore opportunities to support collaboration on shared risks and implementing globally recognized RBC frameworks and expectations. \nThis Seminar is a side session to the Responsible business and Human Rights Forum (#RBHRForum). The RBHR Forum is a multi-stakeholder event addressing an array of priority issues under the Responsible Business Conduct and Business and Human Rights agendas. During this meeting\, METI and DG GROW agreed to hold seminars focused on supply chains in third countries to raise awareness on international expectations on CSR and RBC policies and business practices. \nIn response to this meeting\, and the EU-Japan Economic Partnership Agreement (EPA) coming into force on 1 February 2019\, METI\, DG GROW togher with DG Trade of the European Commission\, and the OECD are jointly hosting this Seminar to facilitate dialogue with business and governments on RBC/CSR\, and explore opportunities for supporting collaboration and implementation. \nImportantly the EPA includes a comprehensive chapter on trade and sustainable development; encouraging CSR and recognising the importance of internationally agreed principles and guidelines\, and expressly referencing the OECD Guidelines for Multinational Enterprises on RBC. \nThe OECD is the leading organisation in providing recommendations on RBC and supply chain due diligence. The OECD Guidelines for Multinational Enterprises (OECD MNE Guidelines) is the most comprehensive set of recommendations from governments to business on RBC\, and are aligned with other key international instruments on business conduct\, including the United Nations Guiding Principles on Business and Human Rights (UNGPs) and the International Labour Organisation Tripartite Declaration of Principles concerning Multinational Enterprises and Social Policy (ILO MNE Declaration).The OECD Due Diligence Guidance for Responsible Business Conduct helps companies understand and implement due diligence in line with the OECD MNE Guidelines and other international instruments and expectations. The Guidance is built on the OECD’s expertise on sector due diligence in supply chains as varied as minerals\, extractives\, agriculture\, garment and footwear and finance; working with business\, governments\, workers and CSOs over the last 10 years. \nThe OECD adopts a multi-stakeholder approach to promoting RBC\, building partnerships and outreach at the global level. The OECD is currenlty working with the European Union (EU) and the International Labour Organisation (ILO) in promoting “Responsible Supply Chains in Asia” (Asia Programme). DESCRIPTION:The EU Delegation in Jakarta is organising an event on 12th March in Bangkok to sensitise the private sector on ASSIST: The ASEAN Solutions for Investment\, Services and Trade http://assist.asean.org/\nThis free online tool has recently been enhanced with additional anonymity features\, and it can now cover matters relating to Trade in Goods and Trade in Services. \nThis event is organised by their regional flagship programme ARISE+. Please find attached the programme and background information on ASSIST.  \n\n\nASSIST: ASEAN Solutions for Investment\, Services and Trade\n\nASSIST in a nutshell\n\nASSIST means ASEAN Solutions for Investment\, Services and Trade.\nASSIST was formally launched at the ASEAN Economic Ministers’ (AEM) Meeting held in August 2016 and then officially presented to the ASEAN business sector at the ASEAN Business Summit 2016. It was initially developed for “Trade in Goods” only. ASSIST has now been extended to “Trade in Services”.\nASSIST for Trade in Services has been soft-launched at the ASEAN Business Summit in November 2018. It will be fully deployed during Thailand’s ASEAN Chairmanship.\nASSIST is a non-binding and consultative mechanism to find solutions to problems encountered by ASEAN-based enterprises on cross-border issues (e.g. when ASEAN enterprises experience trade issues when exporting their goods or services into other ASEAN countries).\nWhen a valid complaint is lodged\, ASEAN Member States should propose a solution within 40 to 60 days maximum.\nASSIST is user-friendly\, internet based and free of charge http://assist.asean.org/\nThe ASSIST mechanism was established to implement the ASEAN Consultations to Solve Trade and Investment Issues (ACT) mandated under the ASEAN Trade in Goods Agreement (ATIGA).\nASSIST is linked to the ASEAN Trade Repository (ATR) and National Trade Repositories (NTR) maintained by ASEAN Member States where trade related information is available.\nASSIST is has an interactive ‘tracking system’ and ‘traffic light’ dashboard that allows the key actors to follow the online proceedings.\nNew features: On top of extending the ASSIST to Trade in Service\, complains anonymity has been enhanced – following feedback from the private sector. DESCRIPTION:Introduction \nThe Foreign Business Act was enacted in AD 1999\, with the intent of protecting Thai industries not yet ready to compete. It replaced an Alien Business law from 1972. An annual review mechanism was intended to allow industries over time to be opened up to competition\, but that system has barely resulted in change. The Foreign Business Act is about commercial presence – ie business activities conducted by entities. Thus a company incorporated in Thailand with less than 50% foreign ownership is a ‘Thai company’ and would not face restrictions under the FBA\, but a company with 50% or more foreign equity would be a ‘foreign’ company. \nIt is a generally accepted view that many industries are ready to compete\, but they remain officially closed. Most companies would benefit from competition\, rather than being harmed by it. The real harm is more likely to be the continued protection\, allowing inefficient and non competitive practices. What should be done better to support the Thailand 4.0 vision? \nWhile Investment Promotion via BOI recognizes the value of foreign investment\, what about other areas?
