The meeting is expected to be concluded by 11:30 hrs. \n  \nAttendance at the AGM: \nIn accordance with the EABC by laws\, only those registered as designated Representatives of paid up EABC Ordinary Members are entitled to attend and cast votes at the AGM. If the registered EABC representative cannot attend\, there are two means to cover the situation: \n  \n(i)       The Ordinary Member company can by its registered Representative\, appoint one second Representative who must be someone associated with the Ordinary Member company. This must be done by written notice (including email with confirmed receipt) to EABC prior to the meeting; or \n  \n(ii)      The Ordinary Member company can by its registered Representative appoint a Proxy\, who must be a registered Representative of any Ordinary Member. \n  \nPlease note that no Representative of an Ordinary Member (company) can hold more than two Proxies in respect of each Ordinary Member (company). That is\, in addition to the voting allowed as Representative of each Ordinary Member company\, the proxy holder may hold a maximum of two proxies in respect of each Ordinary Member company of which he or she is Representative. \n  \nIn addition for planning purposes (including knowing the number of people attending for social distancing purposes)\, if you do plan to attend in person as the current Representative (including second Representative) of an ordinary member\, we seek your kind confirmation of attendance.  Please do confirm by Monday\, 3 August 2020 at 17:00 hrs. by registering \n  \nPlease be advised that fifteen percent (15%) attendances (in person or by proxy) of EABC Members are required to constitute a quorum at the AGM. SUMMARY:EABC Seminar On Foreign Business Act
DESCRIPTION:Introduction \nThe Foreign Business Act was enacted in AD 1999\, with the intent of protecting Thai industries not yet ready to compete. It replaced an Alien Business law from 1972. An annual review mechanism was intended to allow industries over time to be opened up to competition\, but that system has barely resulted in change. The Foreign Business Act is about commercial presence – ie business activities conducted by entities. Thus a company incorporated in Thailand with less than 50% foreign ownership is a ‘Thai company’ and would not face restrictions under the FBA\, but a company with 50% or more foreign equity would be a ‘foreign’ company. \nIt is a generally accepted view that many industries are ready to compete\, but they remain officially closed. Most companies would benefit from competition\, rather than being harmed by it. The real harm is more likely to be the continued protection\, allowing inefficient and non competitive practices. What should be done better to support the Thailand 4.0 vision? \nWhile Investment Promotion via BOI recognizes the value of foreign investment\, what about other areas? How is this foreign equity measured and what does it mean for the economy and possible future change? How are licences granted?
